Contest Rules & Guidelines
I. Overview.
Evite, Inc. (“Evite”) is celebrating its 25 th anniversary with a photo and image contest for its users and the general public. Evite is seeking entrants to submit real photos and videos taken by them from past parties (the “Submission”). Evite will select a subset of Submissions as winners, award them prizes for their Submission, and use their Submissions in an upcoming advertising campaign. The contest will be conducted in conformity with these contest Terms and Rules (“Terms”).
II. Entrant Qualifications.
a. To participate in this contest, the Submitter must be over the age of 18 years, a U.S. resident, and have captured the Submission.
b. Employees of Evite, Inc. and all affiliated entities, as well as family members of such employees are not eligible to participate.
c. Contest winners will be required to verify their age with suitable identification demonstrating age before receipt of the prize.
d. No entrance fee, purchase, or other use of Evite services is required to participate.
e. Submissions not meeting these requirements will be deleted and the Submitter will be disqualified from participation.
f. Submitter may submit more than one but no more than ten Submissions, but may only win one prize.
III. Representations and Warranties.
a. Submitter represents and warrants Submitter is the sole creator and owner of each Submission.
b. Submitter represents and warrants that each Submission does not infringe any intellectual property rights of any third part, including any copyright, trademark, trade secret, or other proprietary rights, does not contain anything libelous or obscene, does not violate any right of any person such as their privacy rights or right of publicity, and the Submission or its submission to the contest does not violate any law. Submissions not meeting this requirement will be deleted and the Submitter will be disqualified from participation.
c. Submitter represents and warrants that Submitter is authorized to agree to all terms and rules set forth in these Terms.
d. Submitter represents and warrants that Submitter has sufficient rights in the Submission to license the Submission as set forth in these Terms.
e. Submitter will indemnify and hold harmless Evite for all damages and the cost of defense of any claim related to any failure to satisfy these Representations and Warranties, including without limitation for any intellectual property claim such as an alleged violation of trademark, copyright, trade dress, right of publicity, or any similar right.
IV. License Rights and Image Ownership.
a. By submitting any Submission, Submitter agrees to all Terms herein.
b. Submitter will be required to agree to a worldwide, perpetual, transferable, irrevocable, non-exclusive license to each Submission for use by Evite, Inc. and any third parties under Evite’s direction for any purpose and in any form or medium now known or hereafter invented, including but not limited to television, streaming platforms, social media, mobile applications, email, print, and on the internet generally.
c. Submitter will retain all other rights, title, and interests in the Submission.
V. Deadline.
Submissions must be received by April 1 to be considered. The deadline may be extended at Evite’s discretion at which point these Terms will be updated to reflect the new deadline.
VI. Decisions on Winners.
a. Evite will evaluate Submissions for consideration with a determination of contest winners by May 30th.
b. Evite is not seeking any particular image or video, but instead wishes to obtain a broad set of images that demonstrate a spectrum of parties and partygoers and that demonstrate the fun of engaging with one’s friends and acquaintances through the years. Accordingly, Evite retains all discretion in selecting any particular image or video or group of images and videos that it deems best suited to its purposes. Preferred Submissions will be nostalgic, include individuals enjoying their party-going experiences, engaged in typical or atypical party-going activities, will be wholesome and promote positive feelings in a viewer.
c. The number of winners of the contest to be determined by Evite in its sole discretion.
d. Non-winners will not be eligible for any prize.
e. The odds of winning depend upon the number of Submissions.
VII. Prizes.
a. Each contest winner will receive $250.
b. Prizes will only be awarded to contest winners following verification of eligibility to participate and confirmation that the Submission conforms to these Terms.
c. Prizes are unique to each winner, may not be substituted for any other prize, item or currency, and may not be transferred or assigned to any third party.
d. The prize will be mailed by check to the winners within thirty days of confirmation that the winner meets all eligibility requirements.
e. In order to be named a winner, each selected Submitter will be required to sign a license agreement including a perpetual, worldwide, non-exclusive license to each winning Submission.
f. A list of winners will be made available on the landing page by June 15th.
VIII. Privacy Notice.
Submitters and winners may be required to provide information relating to their identity to verify age and eligibility to participate in this contest and to enable Evite to communicate with the Submitter. Evite will use any such information in conformity with its privacy policy available here
IX. Void Where Prohibited.
a. This contest is void where prohibited or restricted by law.
b. Contest winners are responsible for all transfer fees or taxes on any prize awarded.
c. All federal, state, and local rules and regulations apply.
